Draft — not yet legally reviewed
These Seller Terms apply in addition to the CZAAH Terms and Conditions whenever you list, offer or sell an item on CZAAH.
If there is a direct conflict between these Seller Terms and the Terms and Conditions on a matter specific to selling, these Seller Terms apply to that matter.
These Seller Terms apply to any user who lists, offers, sells, or attempts to sell an item through CZAAH, whether as a private individual or as a business.
By creating a listing, you agree to these Seller Terms in addition to the Terms and Conditions.
To sell on CZAAH you must meet the minimum age and account requirements set out in the Terms and Conditions.
CZAAH may require you to complete identity verification, payout account setup, or other onboarding steps before you can list items, receive payments, or withdraw funds.
CZAAH may decline, suspend or restrict selling access where reasonably necessary for fraud prevention, legal compliance, or platform safety.
CZAAH may require sellers to provide identity information, such as legal name, address, date of birth, and identification documents, before allowing certain selling activity, higher transaction volumes, or payouts.
Some verification may be carried out by third-party identity or payment providers, whose own terms may also apply.
You must accurately identify whether you are selling as a private individual (outside any business, trade, craft or profession) or as a business seller (acting for purposes relating to your trade, business, craft or profession).
Business sellers may have additional legal obligations toward consumer buyers, including in relation to product information, pricing, cancellation rights and returns.
You must not misclassify your selling activity in order to avoid obligations that would otherwise apply to a business seller.
CZAAH may reclassify an account as a business seller where the pattern or scale of selling activity indicates this is appropriate, and where required by law.
Listings must accurately describe the item being sold, including its condition, defects, functionality and any included accessories.
Photographs and videos must show the actual item being sold, unless clearly stated otherwise.
You must not use misleading titles, descriptions, pricing or categorisation to attract buyers.
You must only list products that you own, or that you are otherwise legally authorised to sell (for example, as an authorised reseller or with the owner's permission).
You must not list an item on behalf of someone else without their authorisation.
You must only list authentic, genuine products. Counterfeit, replica, or unauthorised-copy items are strictly prohibited, in line with the Counterfeit & Intellectual Property Policy.
CZAAH may request evidence of authenticity and may remove listings, cancel sales, or restrict accounts where authenticity cannot reasonably be established.
You must not list items that are prohibited or restricted under the Prohibited & Restricted Items Policy, Product Safety & Recall Policy, or Age-Restricted Products Policy.
CZAAH may remove a listing that breaches these policies without prior notice, subject to applicable law.
You set your own listing prices, unless CZAAH clearly states otherwise for a specific feature.
Where offers are enabled, you may accept, reject or counter an offer from a buyer. An accepted offer may create a binding obligation to complete the sale, subject to the buyer completing payment within any applicable window.
CZAAH may charge seller fees, which may include transaction fees, payment-processing fees, promotional or subscription fees, and other clearly disclosed charges.
Applicable fees will be disclosed to you before you commit to a listing, sale, or paid feature.
CZAAH may change its fee structure from time to time, with notice provided in accordance with the Terms and Conditions.
You are responsible for dispatching sold items within the timeframe shown on the Platform, and for packaging items appropriately for transport.
Where tracked delivery is required for a transaction or for Seller Protection eligibility, you must use an eligible tracked service and keep proof of postage, subject to the applicable CZAAH Protection Policy.
Your obligations in relation to returns and refunds depend on whether you are selling as a private individual or as a business seller, and on applicable law.
Business sellers may be subject to statutory consumer cancellation and refund rights; nothing in these Seller Terms removes those rights.
Private-seller transactions do not automatically carry the same statutory cooling-off rights as purchases from a trader. Where a return, refund or replacement is offered, this is subject to the applicable CZAAH Protection Policy, or to any separate arrangement you and the buyer agree.
Where a buyer raises a dispute concerning your listing or sale, you may be asked to provide evidence such as proof of postage, tracking information, photographs, or correspondence.
CZAAH may make a decision about eligibility under its Buyer or Seller Protection schemes; this does not remove any other legal right either party may have.
Sale proceeds are paid out to you subject to the payment provider's requirements and any applicable holding or review period described in the Payment & Wallet Policy.
CZAAH does not guarantee a fixed payout date for every transaction. Payouts may be delayed where reasonably necessary for fraud checks, dispute resolution, identity verification, or legal compliance.
You must keep your payout details accurate and up to date.
You are responsible for understanding and meeting your own tax obligations arising from your selling activity, subject to any obligation the law places on CZAAH or a payment provider to collect, withhold, report or remit tax.
CZAAH does not provide tax advice. If you are unsure of your tax position, you should seek independent professional advice.
We may request information required to comply with applicable tax, reporting, identity or regulatory obligations.
Where CZAAH is legally required to report information about your selling activity to a tax authority, further detail is set out in the Seller Tax & HMRC Notice.
CZAAH may provide sellers with analytics about their own listings and account, such as views, engagement, offer activity, and sales performance.
Seller analytics are provided for informational purposes and are not a guarantee of future performance.
CZAAH may offer AI-assisted tools to help you create listings, suggest prices, generate descriptions, or otherwise manage your selling activity, as described in the AI Use & Transparency Policy.
You remain responsible for reviewing and confirming the accuracy of any AI-assisted or AI-generated content before you publish it.
Where you create video or other content associated with your listings (for example for CZAAH FOR YOU), that content must comply with these Seller Terms, the Community Standards, and the Music & Audio Policy.
How your content is shown to buyers may be affected by CZAAH's recommendation systems, as described in the Recommendation Transparency page.
If you use CZAAH LIVE to sell, you must also comply with the CZAAH LIVE Policy, including its rules on honest product demonstration, prohibited content, and permitted selling practices.
Any audio you add to a listing, video, or CZAAH LIVE broadcast must comply with the Music & Audio Policy. Only audio made available for authorised use on CZAAH may be used through the platform.
You retain ownership of the content you create, subject to the licence you grant CZAAH under the Terms and Conditions to host, display, and distribute that content as reasonably necessary to operate and promote the Platform.
CZAAH may warn, restrict, suspend, or terminate a seller account for breach of these Seller Terms or other applicable CZAAH policies, in accordance with the Account Suspension & Appeals Policy.
Serious or repeated breaches, including counterfeit goods, prohibited items, or fraud, may result in immediate action.
