Welcome to CZAAH.
These Terms and Conditions (“Terms”) govern your access to and use of the CZAAH website, mobile applications, marketplace, artificial intelligence features, messaging services, live selling features, payment-related services and any other services made available by CZAAH.
Please read these Terms carefully before using the Platform.
By creating an account, accessing the Platform, listing an item, purchasing an item, using CZAAH AI, participating in CZAAH LIVE or otherwise using our services, you agree to these Terms.
If you do not agree to these Terms, you must not use CZAAH.
CZAAH is an online marketplace designed to connect buyers and sellers.
The Platform may provide services including:
Except where we expressly state otherwise, CZAAH is not the owner of products listed by third-party sellers.
The contract for the purchase of an item will normally be between the buyer and the seller.
CZAAH provides the technology and marketplace infrastructure that facilitates the transaction.
You must meet the minimum age requirement displayed during registration to create and operate an account.
Where a user is under 18, additional restrictions or parental requirements may apply.
You must provide truthful and accurate information when registering.

Users who sell as part of a business, trade, profession or commercial activity must accurately identify themselves as business sellers where required.
Business sellers may have additional legal obligations toward consumers, including obligations concerning:

CZAAH may classify or reclassify an account as a professional or business seller where appropriate.
When creating a listing, sellers must provide accurate information about the item.
This includes, where applicable:
Sellers must disclose significant defects or problems.
Sellers must only list products they own or are legally authorised to sell.
Sellers must not use misleading photographs, descriptions or videos.
CZAAH may use artificial intelligence to help sellers create listings.
For example, a seller may:
CZAAH AI may then suggest or generate information including:
AI-generated content may contain errors.
Sellers must review all AI-generated listing information before publishing.
Publishing a listing confirms that the seller has reviewed the information and believes it accurately describes the product.
AI assistance does not remove the seller’s responsibility to provide accurate information.
CZAAH may provide estimated or suggested prices.
These suggestions may be generated using information including:
Price suggestions are estimates only.
CZAAH does not guarantee:
The seller controls the final listing price unless otherwise clearly stated.
CZAAH may offer AI-powered shopping assistance.
Users may ask the AI to:
AI responses may occasionally contain inaccurate or incomplete information.
Buyers should review the actual listing before making a purchase.
Where there is a conflict between an AI-generated summary and the underlying listing, users should rely on the confirmed listing and checkout information.
CZAAH may introduce features allowing users to instruct an AI assistant to take certain actions on their behalf.
For example, a user may instruct an AI assistant to:
An AI assistant must only perform purchasing actions within the scope of authority granted by the user.
Where additional confirmation is required by CZAAH, the purchase will not be completed until that confirmation has been provided.
Users remain responsible for reviewing any permissions or spending limits they give to AI-powered purchasing features.
CZAAH may impose transaction limits, confirmation requirements or additional safeguards on AI-assisted purchasing.
Images and videos must show the actual product being sold unless clearly identified otherwise.
You must have the right to upload any content you provide.
You must not upload content that:
CZAAH may remove or automatically delete certain high-storage media after an item has been sold.
For example, product videos associated with completed sales may be removed after the retention period displayed by the Platform.
CZAAH may retain lightweight transaction information where reasonably necessary for:
Users must not list, buy, sell, advertise or facilitate prohibited or unlawful products.
Prohibited items may include, without limitation:
CZAAH may remove prohibited listings without prior notice where appropriate.
Counterfeit goods are strictly prohibited.
Sellers must not list products that:

We may remove listings, suspend accounts, cancel transactions or cooperate with rights holders or authorities where appropriate.
Sellers are responsible for ensuring products they sell comply with applicable safety laws.
Products subject to recalls, bans or safety restrictions must not be sold where prohibited.
CZAAH may remove a product where we reasonably believe there may be a serious safety issue.
A buyer should carefully review:
Before confirming payment, the Platform will display the relevant transaction information.
Once payment is successfully authorised, an order may become binding subject to applicable consumer rights and these Terms.
Where available, buyers may submit offers to sellers.
A seller may:
An accepted offer may require the buyer to complete payment before the item is considered sold.
CZAAH may set expiry periods for offers.
Sellers determine their listing prices unless otherwise stated.
CZAAH may charge fees including:
Applicable mandatory charges will be disclosed to the user before payment is confirmed.
We will not intentionally hide mandatory fees until after a consumer has committed to the transaction.
Payments must be made using payment methods supported by CZAAH.
Payment processing may be provided by authorised third-party payment providers.
Depending on availability, payment methods may include:
Users may be required to accept additional terms from payment providers.
CZAAH may hold, delay or arrange delayed settlement of payments where permitted through our payment service providers.
For protected transactions, seller funds may not become available for withdrawal until applicable transaction conditions have been satisfied.

Where a transaction qualifies for CZAAH Buyer Protection, a buyer may be eligible for assistance where:
Buyer Protection is subject to applicable rules, deadlines and exclusions.

CZAAH may provide Seller Protection for eligible transactions.

Sellers must dispatch sold products within the timeframe specified by the Platform or agreed with the buyer.
Where tracking is available, sellers should use tracked delivery.
Sellers are responsible for appropriately packaging items.
CZAAH may integrate with third-party delivery companies.
Delivery companies are separate service providers and may have their own terms.
Where a parcel is lost or damaged, responsibility will be determined according to:
Users may be asked to cooperate with an investigation or delivery claim.
Return rights depend on factors including:
Nothing in these Terms removes rights a consumer has under applicable law.
Where both parties are individuals acting outside a business or profession, certain consumer cancellation rights applicable to trader-to-consumer transactions may not apply.
However, sellers must still describe items honestly and must not engage in fraud or misrepresentation.
CZAAH Buyer Protection may provide additional contractual protection where applicable.
Where a business seller sells to a consumer, statutory consumer rights may apply.
Business sellers are responsible for complying with those obligations.
CZAAH does not permit a seller to use Platform terms to remove statutory consumer rights.
Consumers purchasing from qualifying business sellers may have statutory cancellation rights for certain distance contracts.
Exceptions can apply depending on the nature of the product.
Business sellers must comply with applicable cancellation and refund requirements.
Where a refund is approved, the refund may be issued to the original payment method or another permitted method.
Refund processing times may depend on the payment provider.
Where required by law, statutory refund rights take priority over conflicting Platform rules.
Buyers and sellers should first attempt to resolve issues through CZAAH’s dispute process.
CZAAH may request evidence from either party.
We may review:
CZAAH may make a decision regarding eligibility under its contractual Buyer or Seller Protection schemes.
This does not remove any right a user may have to pursue legal remedies.
Users may be permitted to leave reviews after transactions.
Reviews must reflect genuine experiences.
Users must not:
CZAAH may use automated and manual systems to detect suspicious review activity.
Users may communicate through CZAAH messaging.
Messages must not be used for:
Where legally permitted and proportionate, messages may be processed using automated systems to detect fraud, abuse and prohibited content.
Users should not attempt to move a protected CZAAH transaction outside the Platform to avoid fees or protections.
CZAAH Buyer and Seller Protection may not apply where users choose to complete payment outside CZAAH.
Never send money directly to another user merely because they provide bank details or payment instructions in a message.
CZAAH may provide live-streaming features known as CZAAH LIVE.
Sellers may use CZAAH LIVE to:
Users broadcasting live content must comply with these Terms and all applicable content policies.
CZAAH LIVE must not be used to broadcast:
CZAAH may stop or remove a live stream where necessary.
Users retain ownership of content they create, subject to the rights they grant CZAAH under these Terms.
By uploading content, you grant CZAAH a non-exclusive, worldwide licence to host, store, reproduce, display, process and distribute that content as reasonably necessary to operate, improve and promote the Platform.
This licence ends when the content is deleted except where continued retention is legally required or reasonably necessary for completed transactions, disputes, security or backups.
CZAAH and its associated branding, software, interface, logos, designs and technology are protected by applicable intellectual property rights.
You may not copy, reproduce, scrape, reverse engineer, distribute or commercially exploit CZAAH technology except where permitted by law or with written authorisation.
CZAAH may use automated and manual systems to identify suspicious activity.
This may include analysis of:
We may delay or restrict transactions where reasonably necessary to investigate suspected fraud, security incidents or prohibited activity.
CZAAH may require users to provide information including:
Some verification may be performed by third-party providers.
Marketplace operators may be legally required to collect and report information about certain sellers to tax authorities.
Where required by law, CZAAH may request information needed for reporting or verification purposes.
Users remain responsible for understanding and meeting their own tax obligations.
Sellers are responsible for determining whether taxes apply to their marketplace activity unless the law requires CZAAH or another provider to collect or account for the tax.
Where required by law, CZAAH may collect, withhold, report or remit applicable tax amounts.
CZAAH may restrict an account where reasonably necessary for reasons including:
Where appropriate and legally required, users will be informed of significant account actions.
Users may close their account subject to unresolved transactions, disputes or legal retention obligations.
CZAAH may terminate an account for serious or repeated breaches of these Terms.
Closing an account does not remove obligations arising from previous transactions.
CZAAH may use AI and automated technology to:
Automated systems may make mistakes.
Where appropriate, CZAAH may provide a mechanism for users to challenge significant decisions or request human review.
CZAAH may rank marketplace content using factors such as:

CZAAH may modify ranking systems over time.
We aim to provide reliable access to CZAAH but cannot guarantee uninterrupted availability.
The Platform may occasionally be unavailable due to:

Nothing in these Terms excludes or limits liability where doing so would be unlawful.
In particular, nothing in these Terms excludes liability for matters that cannot lawfully be excluded.
CZAAH does not seek to remove or reduce statutory consumer rights.
To the extent permitted by law, CZAAH is not responsible for losses that were not reasonably foreseeable when the relevant contract was formed.
Where CZAAH acts solely as marketplace intermediary, it does not automatically become responsible for every act or omission of an independent buyer or seller.
CZAAH does not guarantee that:

Where a material change affects an existing paid service or materially affects users’ contractual rights, we will provide notice where required.
We may update these Terms from time to time.
The latest version will display an updated effective date.
Where required, we will provide reasonable notice of material changes.
Continued use of CZAAH after changes take effect constitutes acceptance where legally permissible.

Where legally required, optional cookies will only be used after appropriate consent.
Users may submit complaints through the CZAAH Help Centre or official support channels.
We aim to consider complaints fairly and within a reasonable timeframe.
Additional dispute resolution processes may be available where required or offered.
These Terms are governed by the laws applicable to CZAAH’s contracting entity and the user’s applicable consumer rights.
If you are a consumer resident in the United Kingdom, nothing in these Terms removes any mandatory protections you have under applicable UK law.
Jurisdiction provisions will not deprive consumers of mandatory legal rights to bring proceedings in a court available to them under applicable law.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.
If CZAAH does not immediately enforce a provision of these Terms, this does not mean that CZAAH has waived its right to enforce that provision later.
These Terms, together with any policies expressly incorporated into them, form the agreement governing your use of CZAAH.
